Real Estate Terms for Homebuyers
Area and Ownership
Carpet Area
Under RERA, carpet area broadly refers to the net usable floor area of an apartment. It excludes external walls, service shafts, exclusive balconies, verandahs and open terraces, while including internal partition walls. Compare properties using the same measurement basis.
Built-up Area
Built-up area commonly includes the carpet area together with the thickness of walls and other specified areas. The calculation can vary, so confirm exactly what the project’s area statement includes.
Super Built-up Area
Super built-up area commonly combines the built-up area with a proportionate share of common spaces. It is not the same as a carpet area. Ask the developer to provide the complete calculation in writing.
UDS - Undivided Share
UDS represents the buyer’s proportionate share in the land associated with an apartment. Confirm the stated UDS and how it is recorded in the agreement and the registered document.
Common Area
Common areas are spaces or facilities intended for shared use within a development. Their precise scope should be checked in the applicable law, approved information and project documents.
Floor Plan
A floor plan shows the arrangement and dimensions of rooms, walls, doors, balconies, kitchens, toilets, and circulation spaces. Compare it with the stated carpet area and the approved plan.
Documents and Legal Records
Title
Title refers to the legal rights or ownership interest associated with a property. An independent advocate should examine the title documents, seller’s authority and transaction history.
Parent Document and Title Chain
A title chain is the sequence of documents showing how rights in the property moved between previous and current owners. The required review period and documents depend on the property’s history.
Agreement for Sale
An Agreement for Sale records the proposed transaction, property details, price, payment schedule, specifications, possession terms and responsibilities of the parties. Review the draft independently before signing.
Sale Deed
A Sale Deed is the registered instrument commonly used to complete the transfer of property rights from seller to buyer. The property description and parties should match the reviewed records.
Encumbrance Certificate — EC
An Encumbrance Certificate reports registered transactions available for the selected property and search period. It is an important check, but it should not be treated alone as proof of clear title.
Patta
Patta is a Tamil Nadu revenue record containing landholding and survey-related particulars. It should be compared with the title, survey and other applicable records and should not be used alone as a title conclusion.
Power of Attorney — POA
A Power of Attorney authorises one person to act for another within a defined scope. Verify its execution, validity, registration where applicable and authority for the proposed transaction.
Approvals and authorities
RERA and TNRERA
RERA commonly refers to the Real Estate (Regulation and Development) Act and its regulatory framework. TNRERA is the Tamil Nadu Real Estate Regulatory Authority. Check the official project record where registration applies.
Planning Permission
Planning permission authorises a proposed development according to the sanctioned plan and applicable planning rules. It does not independently establish property ownership or clear title.
CMDA and DTCP
CMDA is the planning authority for the Chennai Metropolitan Area. DTCP handles planning matters within its applicable jurisdiction. The correct authority depends on the property’s location and proposal.
Floor Space Index - FSI
FSI is the relationship between the permitted built floor area and the plot area. The applicable calculation depends on planning rules, property use, road conditions, and location.
Completion Certificate
A Completion Certificate is associated with confirmation that construction has been completed according to applicable approvals and requirements. Verify whether it is required and available for the exact property.
Occupancy Certificate - OC
An Occupancy Certificate relates to whether a completed building may be occupied under the applicable rules. It is not a title document and does not replace ownership verification.
Costs and finance
Price Break-up
A price break-up or cost sheet lists the base price and applicable additional costs such as parking, taxes, registration, maintenance, and other charges. Ask for the complete amount in writing.
Booking Amount
A booking amount is an initial payment made when expressing an intention to purchase. Review the cancellation, refund, and adjustment terms before paying.
Down Payment
A down payment is the portion of the purchase cost paid from the buyer’s own funds rather than through the home loan. Its timing should match the written payment schedule.
Home Loan
A home loan is borrowing secured against the property, subject to lender eligibility and repayment conditions. A lender’s review should not replace independent legal verification.
EMI
EMI means Equated Monthly Instalment. It generally combines principal and interest repayment according to the loan amount, interest rate, and tenure.
Guideline Value
The guideline value is the value maintained by the Tamil Nadu Registration Department for registration-related purposes. It may differ from the agreed sale price or current market value.
Stamp Duty and Registration Charges
Stamp duty is a government levy on specified instruments, while registration charges relate to registering the document. Verify the current rate, calculation, and applicable concessions through official sources.
Land, plot and handover terms
Survey Number
A survey number identifies a particular land parcel in the relevant records. Confirm that it remains consistent across the title, Patta, approval, and transaction documents.
Subdivision Number
A subdivision number identifies a separated portion of a larger survey parcel. Verify the subdivision and extent against the current records and physical boundaries.
FMB Sketch
An FMB, or Field Measurement Book, sketch records survey measurements and boundary information. It should be interpreted with the survey and title documents by a qualified professional.
Layout Approval
Layout approval relates to the planned division of land into plots, roads, and applicable common areas. Verify the approval number, issuing authority, and exact survey details.
Land Classification
Land classification records how land is categorised for revenue or planning purposes. Confirm the present classification and whether the intended use is permitted.
Access and Right of Way
Access describes the physical and legal route to a property. Inspect the route and verify that any right-of-way is properly documented and usable.
Possession Date
The possession date is the handover timeline stated in the applicable agreement. Review the conditions, dependencies, and delay provisions rather than relying only on promotional material.
Handover
Handover is the practical process of delivering the property, keys, documents, and agreed items to the buyer. Record incomplete work, pending documents, and meter or maintenance details in writing.
Maintenance Charges
Maintenance charges support the upkeep and operation of common areas and services. Confirm the amount, starting date, billing basis, and services covered.
Farmland Plot
A farmland plot is land offered for agricultural, farm-related, or other permitted use. Verify its title, classification, documented access, survey details, restrictions, and permitted use independently.
